Services for other Organizations
Affordable housing represents one of the most important elements of national and local government policy in Britain. For the various providers – housing associations, registered charities, co-operatives and local councils – successful execution of that policy depends on efficient handling of the numerous legal issues involved.
As a registered social landlord, you need the best legal advice and support available, and Blavo &Co’s Social Housing team is here to provide it. We will help you manage your responsibilities in the most effective way possible, so that your time involvement is minimised and costly problems are avoided.
Our lengthy experience covers every aspect of housing management, including disposals of surplus stock and stock transfers.
We advise on every aspect of social housing, both contentious and non-contentious, particularly the law relating to secure and assured tenancies.
We also provide a full service in the drafting of tenancy agreements, including introductory and assured short-term tenancies, and the formulation of anti-social behaviour policies.
Further areas of expertise include rent increases for secure and assured tenancies, rent possession and nuisance possession cases, injunctions relating to statutory inspections, disposals of land held for housing purposes, land transfers with grant aid and formulation of grant agreements.
For instance, in dealing with tenants, social landlords have to balance their obligations as regulated social landlords and the need for proper tenancy management against consideration of the circumstances of their tenants and those who may be affected by tenants’ behaviour.
You will want to ensure that appropriately drafted tenancy agreements are in place, together with policies and procedures relating to aspects of tenancy management such as lettings, repairs, tenancy
support, and income recovery and taking possession.
Disputes with Social Housing Tenants
When disputes with tenants escalate to the point that legal action is contemplated, you will require expert legal advice to ensure preliminary steps are carried out properly. It will be important to have expert representation if court proceedings are necessary, for example where you are:
- Seeking a possession order or an injunction in relation to anti-social behaviour
- Taking action where a tenant persistently fails to pay rent due or breaches other tenancy terms
- Seeking possession where a property has been sublet or the original tenant has left the property or died, leaving an unauthorised occupier in possession
- Seeking an injunction for access where a tenant is refusing access for repairs or for essential inspections or gas safety checks
- Defending claims or counterclaims brought by tenants, e.g. for alleged breach of repairing obligations
