Blavo & Co Immigration Team Success

Well done Blavo and Co Immigration team for managing to have a client returned to the UK who had unlawfully been removed. Our client claimed asylum on the grounds of his social group in Albania. Despite having several wounds and suffering from a severe and recognisable mental illness, the claim was refused and certified as being manifestly unfounded.

Removal directions to Albania were set for 16.01.2012 at 16.25pm. Blavo and Co were instructed on the same day. Present UKBA policy states that removal will be deferred if the proposed return is by way of a non chartered flight and confirmation of judicial review proceedings are faxed to them before the intended removal.

Judicial review proceedings were subsequently issued at the Royal Courts of Justice and received by UKBA at 16.10pm. Blavo and Co requested a stay on removal. Our request was ignored and when we contacted UKBA at 16.15pm we were advised that the client was in mid air.

Blavo & Co made it clear that the removal was in breach of UKBA policy and demanded his return to the UK threatening further court action against UKBA. A telephone call was subsequently made by the Immigration Officer to the escorts on the plane and the client was subsequently brought back to the United Kingdom from Italy where he was en route to Albania. We now intend to challenge UKBA’s decision that his case was manifestly unfounded.
